 A May 2014 report from the League of American Bicyclists reads, “We don’t know much about the consequences of most crashes that result in bicyclist fatality.” Based on incomplete data, the report estimates, “Nationally, 45 percent of fatal cyclist crashes had some indication of a potential enforcement action; 21 percent had evidence of a likely charge; [and] 12 percent resulted in a sentence.” Put another way, killing a cyclist with a car was effectively legal in more than seven of every eight cases.
In 2010, a glimmer of hope was sparked in New York when Hayley and Diego’s Law was passed. The law, which focuses on penalties specific to careless driving, is designed to enable prosecutions of drivers who hit bicyclists and pedestrians—a previously difficult task because no appropriate penalties existed. 
New York City’s biggest roadblock when it comes to prosecuting cycling accidents is a bizarre loophole that is applicable to the majority of collisions. “Right now, what New York misses that other states have is that the police cannot issue a summons unless an act was committed in their presence,” says local bike attorney Dan Flanzig. This means most bicyclists can expect police action only if a cop happens to watch with his or her own eyes as they get flattened on the pavement.

Anthony J. Marsal is 24 and was showing signs of intoxication, he was charged with 2nd-degree vehicular homicide and drunk driving.

    Woman with no license mows down bicycles head-on in New Hampshire Saturday september 21, 2013 20-year-old Darieann Hess of Seabrook, New Hampshire with  no license crossed the center line and appeared to drive directly into a group of riders on a bridge in Hampton, N.H, killing two women and injuring two others. Police are conducting a criminal investigation, including confiscated her car, her phone, and they took a blood sample.

    Everett Motorcycle Deputy Rammed By Wrong Way Driver
    June 13, 2013 Snohomish County Sherriff motorcycle in Everett was hit and dragged by an old  Lexus ES which for no known reason crossed over into oncoming traffic on Evergreen Way. The Lexus driver was taken to the hospital. The deputy was knocked off the motorcycle expected to survive. A trooper on a motorcycle had been killed in nearby Skagic County on May 31 where traffic had been redirected around the fallen span over Interstate 5.

Barnett The King County Prosecutor's Office has set bail for Nathan Godwin, the 27-year-old suspected drunk driver who struck and killed cyclist Bradley Nakatani, 35, on Thursday morning at $500,000. Godwin was booked into King County Jail yesterday on suspicion of vehicular homicide.

    October 7, 2010 Motorcycle Hit By Wrong Way Texting Minnesota Mom  Elizabeth Manzanares, 20, was charged with felony criminal vehicular operation and two counts of child endangerment. She was allegedly texting with her head down when she drove with her 2 daughters into the opposing lane into the motorcycle critically injuring Barry Lawrence, 65, of Minnetonka.  Manzanares also faces charges of driving without a license, driving without insurance and texting while driving, all misdemeanors but she was not jailed, She was free from alchohol and drugs and denied texting and was driving her mother's car with a learner's permit, but later claimed that she "blacked out" and didn't remember the accident.

    David Mark Clark Mows Down Bicycles With SUV in San Francisco
    Wednesday June 2, 2010 David Mark Clark  of Albany CA struck four bicyclists were all struck within a six-minute period between 9:43 p.m. and 9:49 p.m. in the city's Mission and Potrero Hill neighborhoods. It ended when his Nissan Rogue SUV crashed into a parked car and hit a pole, leaving his wallet and phone and running away. He was seen driving on the wrong side of the road appearing to target the riders. No motive was identified. The man was arrested when we went to police to report his vehicle had been stolen in a carjacking. Clark identifies himself as an "avid cyclist" and "spiritualist tennis pro".He was charged with "four counts of attempted murder, four counts of assault with a deadly weapon, and three counts of battery causing serious injury." His occupations included Reiki Master, Priest in the Order of Melchezidek, and Crystal therapist.
