The SWAT Raid That Killed a Marine
Arizona - Jose Guerena, 26, who joined the Marines in 2002 and served two tours in Iraq, was killed just after 9 a.m. May 5 during a SWAT Raid. Here is the helmet cam footage of the event captured by the SWAT team. Late Thursday afternoon the Pima County Sheriff's Department, responding to public records requests, released video and documents related to the shooting of Jose Guerena. Guerena died on May 5 when a SWAT team arrived at his Pima County home to serve a search warrant. The SWAT team's attorney has said that when the team broke down the door, they saw Guerena standing there with a rifle and that he said, "I've got something for you." The team then opened fire. The Sheriff's Department revealed earlier that the team expended 71 rounds.

  • Ten months after the raids and the killing, on 2 March 2012 Guerena's two brothers Alejandro Guerena, 28, and Gerardo Guerena, 24; along with Alejandro's wife, Pauline Guerena, his sister-in-law, Denise Ruiz, and his father-in-law, Jose Celaya were indicted, and it was alleged that they imported and sold at least $4.9 million worth of marijuana between 2005 and the time of the fatal raid. The Guerena brothers have outstanding warrants for their arrest. Ruiz and Pauline Guerena were released from jail to the county's Pretrial Services agency, and Celaya posted a $50,000 bond.[26]
On August 12, 2011 it was announced that the family of Jose Guerena filed an intention to sue Pima County Sheriff Dupnik, and all the officers who shot Guerena or were part of the raid, offering to settle for $20 million. The lawsuit cites that the officers acted with negligence when they failed to announce themselves and put Guerena's wife and son in danger, and willingly deprived Guerena of medical attention after he was shot, leading to his death, and violated his civil rights. Christopher Scileppi, a Tucson attorney, was hired to represent the family. [27]Scileppi says the lawsuit is meant to hold those accountable for Guerena's death and send a message to officers who have unlawfully killed citizens, as well as clear Jose Guerena's name. The lawyer for the officers, however, said[citation needed] that the lawsuit is only to cause more "hysteria" and the amount is excessive since the officers had already been cleared of wrongdoing.

May 20, 2011 · Tucson SWAT officers who killed ex-Marine Jose Guerena during a drug raid have said that they did not find any drugs in his home.

    [extreme right sides with Guerena]
No evidence of drug smuggling or other illegal activity was found at Jose Guerena’s home during the fatal May 5, 2011 raid. The indictment mentions that the SWAT team found body armor, several guns (including a rifle), a dozen cell phones, and a cap embossed with the U.S. Border Patrol logo. None of the weapons was described as “illegal.” Nor is it a crime for a private citizen to own body armor (nor is it surprising to find it in the home of a combat veteran of multiple tours in Iraq). Guerena, who was working the graveyard shift at a local copper mine, had expressed an interest in joining the Border Patrol.
Capt. Christopher Nanos, head of the criminal investigations division for the Pima County Sheriff’s Office, insists that despite the lack of compelling evidence against him, Jose Guerena was a criminal: “Although he was a former Marine, it doesn’t mean that he was out there doing what we expect good Marines to do.”
Guerena was gunned down in his own home without the benefit of a trial.

After getting the weapon, the soldier stole a military vehicle and drove to the clinic, where earlier he had been in a fight, the official said.
The shooter was identified as Army Sgt. John M. Russell, according to Maj. Gen. David Perkins, the military spokesman who briefed reporters in Baghdad, Iraq, on Tuesday.
Russell has been charged with five counts of murder and one count of aggravated assault after the shooting at Camp Liberty, near Baghdad's international airport, Perkins added. Video Watch how the Army is handling the case »

On May 11, 2009, five United States military personnel were fatally shot at a military counseling clinic at Camp Liberty, Iraq by Army Sergeant John M. Russell.
2005 Deaths of Phillip Esposito and Louis Allen
      • The fragging deaths of Phillip Esposito and Louis Allen occurred on June 7, 2005, atForward Operating Base Danger in TikritIraqCaptain Phillip Esposito and First Lieutenant Louis Allen, from a New York Army National Guard unit of the United States42nd Infantry Division, were mortally wounded in Esposito's office by a Claymore mineand died.
Military investigators determined that the mine was deliberately placed in the window and detonated to kill Esposito and Allen. Staff Sergeant Alberto B. Martinez, who was in the officers' unit, was charged with two counts of premeditated murder. In 2006, two years before the trial, he volunteered in a plea bargain to plead guilty to murder in exchange for a life sentence without parole; the convening authority rejected the deal. In the court martial, Martinez was acquitted on December 4, 2008 at Fort BraggNorth Carolina.Looks like man upset about getting fired from National Guard rather than any outward signs of Jihad, set claymore mine in office to kill 2 officers. Esposito and Martinez had come into conflict before arriving in Tikrit in April 2004, as Esposito tried to bring the sergeant in line.[5]Martinez was later described in court "as a poorly disciplined and foul-mouthed guardsman who needed a special waiver to qualify for duty."[2] Witnesses testified that Martinez "could not account for hundreds of thousands of dollars in missing equipment."[2] Esposito eventually restricted Martinez from going into the supply area without an escort.[2] Martinez feared Esposito would get him kicked out of the Guard, costing him $2,859 in monthly pay.[2]
Witnesses later testified that Martinez had openly threatened to kill Esposito.
Martinez's defense team countered that the Army's evidence against Martinez was circumstantial, and prosecution witnesses' testimonies were inconsistent. The defense team also presented evidence that Martinez was not the only soldier in the unit with a grudge against Esposito. After two days of deliberations, the jury acquitted Martinez on December 4, 2008. In the military, a two-thirds vote by the jury is needed for conviction. The prosecutor in the case speculated that some jurors' known opposition to the death penalty may have influenced their votes for acquittal.[6]

        Acquittal and honorable discharge[edit]

Soon after his acquittal, Martinez received an honorable discharge from the military; he "proclaimed his innocence and a sense of vindication."[6] The prosecution repeated their belief that he was guilty; they were crushed by the verdict. The U.S. Army has not publicly identified or charged any other suspects in the killings.[6]

Why I Murdered 13 American Soldiers at Fort Hood: Nidal Hassan Explains It All to You

      By Barry Rubin
How do we know that the attack at Fort Hood was an act of Islamist terrorism? Simple, Major Nidal Hassan told us so. You’ve seen reports of a long list of things he did and said along these lines. But what’s most amazing of all is this:
Hassan is the first terrorist in history to give an academic lectureexplaining why he was about to attack. Yet that still isn’t enough for too many people-including the president of the United States–to understand that the murderous assault at Fort Hood was a Jihad attack.
It was reported that the audience was shocked and frightened by his lecture. He was supposed to speak on some medical topic yet instead talked on the topic: “The Koranic World View as it Relates to Muslims in the U.S. Military.” All you have to do is look at the 50 Power Point slides and they tell you everything you need to know.
It is quite a good talk. He’s logical and presents his evidence. This is clearly not the work of a mad man or a fool, though there’s still a note of ambiguity in it. He’s still working out what to do in his own mind and is trying to figure out if he has a way out other than in effect deserting the U.S. army and becoming a Jihad warrior. Ultimately, he concluded that he could not be a proper Muslim without killing American soldiers. Obviously, other Muslims could reach different conclusions but Hassan strongly grounds himself in Islamic texts.
