2 killed 1 injured, ruled accident no charges June 14, 2010  Faegh Behbahani San Francisco Taxi Crash   DeSoto Cab Co. driver, Faegh Hassan Behbahani, 50, of Daly City, was taking Ohio tourists Karen Marshall, 59, and her husband Dennis Marshall, 61 from San Francisco International Airport when the driver claims he smelled smoke as  he passed Candlestick Park. He exited the freeway, as a passing car took a picture of  his cab on fire. He found his brakes didn't work and he accidentally crashed into a freeway pillar. While the driver got out by himself with injuries, two sheriff's deputies suffered smoke inhalation pulling the couple out of the back who later died. The driver was not arrested but the Medical Examiner’s Office found the couple died of multiple blunt-force injuries rather than fire hours after the crash and ruled the couple’s death as a homicide. CHP officers initially said since Behbahani ignored the smoke and continued to drive, he could have been charged with murder. Behbahani had worked with DeSoto for six months, has a valid license and a clean record, and the car passed inspection Jan. 10, with 286,000 miles.  In Jan 4, 2011, a California Highway patrol probe found for "second-degree [murder], you have to have malice. And we didn't see there was sufficient evidence to support malice," Lobb said.and left it for the district attorney to press charges, which it did not. Incidentally, he has the same name as famous Iranian poet Simin Behbahani.

Some articles mention that the medical examiners determined the passengers from Ohio had died from blunt force injuries, possibly from the force of the crash, and they called it a homicide, and  the high way patrol said it could be murder because the driver could have simply slowed down and pulled over, but instead decided to keep driving and crash into a fixed pillar. Looks like the driver and taxi company without getting charged or sued for anything...

June 14, 2010 Two tourists die in San Francisco when their cab driven by Faegh Behbahani catches fire on I280 by Candlestick park. Rather than pulling over, because he has brake trouble he drives on several miles to an offramp when he says both main and emergency brakes fail and hits a freeway pillar. An anonymous photographer in another cab posted a picture from besides the cab on fire just before the crash. Three sheriff’s deputies followed and watched the crash and stopped to extinguish the flames and rescue the couple The driver escaped, but two policemen who saw the fire and pulled out the victims from the back. The officers were hospitalized for smoke inhalation. The couple died hours later in the hospital. The Medical Examiner’s Office said the couple died of multiple blunt-force injuries from the accident rather than the fire, and ruled the couple’s death as a homicide. But after an investigation, the California Highway patrol did not find enough evidence for murder, remarking it could be merely manslaughter, and left it for the district attorney to press charges.

It may be a week before investigators determine the exact cause of the fiery taxi crash that killed two tourists from Cincinnati, the California Highway Patrol said Tuesday.

Investigators are looking at how much time elapsed between when the driver, Fageh Hassan Behbahani, 49, of Daly City, may have first smelled smoke, somewhere around Candlestick Park, and when he exited Interstate 280 at Mariposa Street around 11 a.m. Monday.

Behbahani told investigators that is when the brakes of the DeSoto Cab Co.’s Dodge Intrepid stopped working. It caught fire and slammed into a freeway pillar at 40 mph, CHP Officer Shawn Chase said.

“If I were in that situation, the prudent thing is to pull over and check it out right away. Try to get off the freeway,” Chase said. “But it’s still an open investigation.”

Behbahani has not been arrested, Chase said.

Faegh Behbahani was driving the Dodge Intrepid taxi when it caught fire before careening into a freeway pillar at 40 mph June 14. He said the crash occurred because the brakes on the vehicle failed. Behbahani smelled smoke almost four minutes prior to the crash, according to CHP Lt. Dane Lobb, who has been investigating the case.

CHP officers initially said since Behbahani ignored the smoke and continued to drive, he could have been charged with murder.

However, the CHP is submitting a report to the District Attorney's Office this week concluding that evidence did not support a homicide charge.

"In order for there to be second-degree [murder], you have to have malice. And we didn't see there was sufficient evidence to support malice," Lobb said.
