March 16, 2017 Rockville High Immigrant Rape Case , a fourteen year old female student was allegedly forced into a bathroom in the school and raped, sodomized, and forced to perform oral sex by two fellow students, both also in the 9th grade.[11][12][13][14] The two perpetrators, Henry E. Sanchez-Milian, 18, and Jose O. Montano, 17, were in the country illegally;[15] the former from Guatemala and the latter from El Salvador.[12] Rockville H.S. has a policy of placing students in the relevant grade based on academic achievement rather than by age.[16] Sanchez-Milian was apprehended by the U.S. Border Patrol in August 2016 in the Rio Grande Valley border area of Texas, and it was determined that he entered the country illegally from Mexico;[11][12] he was subsequently released and ordered to appear before an immigration judge although the hearing had not yet been scheduled.[12][17] The Border Patrol agent had the authority to detain Sanchez-Milian and send him back across the border but instead chose to release him pending a hearing as he did not fall into a priority category for deportation.[18] Maryland Governor Larry Hogan accused the school system of "withholding information from the Maryland State Board of Education about the rape and the students involved."[19] Montgomery County Public Schools Superintendent Jack Smith told reporters the 18-year-old student was enrolled in a class with younger students because he deserved the "best services for his needs"[18] and condemned the surge of racist, anti-immigrant sentiment because of the incident stating: "That is not the community I moved to last summer. It is not the community I want to live in."[20] The system is legally prohibited from denying education based on immigration status.[20]
