April 16, 2014 Dawn Nguyen guilty of giving guns in firefighter gun ambush Dawn Nguyen was found guilty falsifying business records, a first degree charge. She faces a maximum of four years in prison. Nguyen is accused acting as a "straw purchaser" providing 2 of the 3 weapons William Spengler used to kill his sister Cheryl and two firefighters Tomasz Kazcowka, 19, and Michael Chiapperini, 43 on Christmas Eve in 2012 when he set his care on fire as a lure for a military commando style ambush before committing suicide. Two other firefighters were wounded. She told the seller of these guns, Gander Mountain in Henrietta, that she was to be the true owner and buyer of the guns instead of William Spengler, when it is against federal law to provide false information related to the acquisition of firearms. Filled filled out a form in 2010 when she bought an AR-15-type semiautomatic rifle and a 12-gauge shotgun for her neighbor, William Spengler Jr., a convicted felon. Dawn also faced charges of illegal marijuana use.

Investigators initially focused on Welsher when they began looking into the guns. A rambling suicide note left behind by Spengler admitted that he had asked Nguyen's mother, Dawn Welsher, to buy the guns for him, and that she "duped" her daughter into making the purchase instead.

She faced federal charges for allegedly lying on a firearms form, selling to a known felon and an unlawful use of marijuana.

Text messages sent to Dawn on the day of the terrorist attack about "Billy" who was the shooter Spengler. She allegedly replied LOL "Laughing Out Loud" about the shooting, and that "Billy" was mad rich and wondered what he would do with the money

A friend texted Dawn Nguyen that he had just heard what happened in Webster.

"Was it crazy dude you guys always talk about?" he asked.

"Yup," came the reply from Nguyen's phone. "LOL."

Further texts from Nguyen's phone said that "Billy" had been at her house three weeks earlier and when she saw what had happened, she knew "for sure who's doing it" — an apparent reference to the shooting. Another text said the gunman "definitely had it planned" and that his mother's obituary had directed donations to the "west side department."

"It definitely has to do with why the firefighters got shot," the message said, according to copies read aloud in court.

A final message said she did not expect Billy to kill himself, that he was "mad rich" and she wondered what he did with his money.

    Updated: 4:58 p.m. ET ~ An upstate New York woman was arrested Friday and hit with federal and state charges connected to the fatal shootings of two volunteer firefighters on Christmas Eve.

    The woman, Dawn Nguyen, 24, faces federal charges of knowingly making a false statement in the purchase of guns in connection with the weapons used in the slayings, U.S. Attorney William Hochul told a news conference Friday. 

    She was charged earlier on a state violation of filing a falsified business record.

    Hochul said Nguyen bought the guns on behalf of William Spengler, 62, who allegedly shot four firefighters responding to a fire he had started in his home on Monday outside Rochester, N.Y., killing two of them, before killing himself.


    Nguyen "told the seller of these guns, Gander Mountain in Henrietta, that she was to be the true owner and buyer of the guns instead of William Spengler," he said.
    "It is absolutely against federal law to provide any materially false information related to the acquisition of firearms."


    The complaint alleges that Nguyen acted as a "straw purchaser" for Spengler, who, as a convicted felon, could not legally own, acquire or purchase any firearm, he said. 
    The charges are related to an AR-15-type semiautomatic rifle and a 12-gauge shotgun — two of the three weapons found near Spengler's body Monday, according to State Police Investigator James Sewell.
