December 8, 2017 Roberto Garza Palacios llegal Alien Crashes Into FBI and Fire officials  Lawyer for Roberto Garza Palacios says he accidentally swerved into the shoulder to avoid striking the disabled stopped vehicle before hitting and killing FBI agent Carlos Wolff and Deputy State Fire Marshal Sander Cohen.[2] Suspect had served a four months in jail after smashing windows on 16 cars with a metal bar and lighting a sofa on fire near a construction site with no clear motive. [3]   Palacios was not required to appear in court, and only had to pay $280 traffic fine. Wolff's wife, Marla said the "sentence was just a slap on the wrist to Palacios"  and though Palacios claimed that he did not see both men on the shoulder, "No brakes were applied,  [officials] found no skid marks [from Palacios'] brakes, and in addition it was found that his car brakes were faulty," Wolff said. Palacios pleaded guilty to DWI in 2015, according to The Washington Post and spent four months in jail after being arrested for vandalizing car windows. [7]

The 28-year-old Guatemalan native was an illegal immigrant after he overstayed after his work visa that expired in 2009. ICE previously lodged a detainer in August 2015 after arrest on local charges, but ICE  was not notified of his release from Montgomery County custody because of sanctuary policies where authorities are prohibited from honoring ICE detainers [6] [4] [8] Most of the MS-13 gang member releases were in Maryland, with five MS-13 members released by Montgomery County.  On May 3 Palacios was taken into custody at his Maryland home Thursday and has been charged with violating the terms of his work visa. [1]
