December 20, 2011 Shooting of Anthony Lamar Smith By White Police Officer Police chased Anthony Lamar Smith after watching him in a drug deal and trying to run over police officers. When cornered, he was shot and killed by former St. Louis Police officer Jason Stockley who feared that the suspect had found a gun, and later found a gun in the car which tests showed had DNA of the officer but not the suspect. Stockley was charged with first-degree murder after prosecutors believe he planted the gun. On September 15, 2017, Stockley was found not guilty of first-degree murder, and protests erupted in St. Louis.[2]

“This court, in conscience, cannot say that the State has proven every element of murder beyond a reasonable doubt or that the State has proven beyond a reasonable doubt that the defendant did not act in self-defence,” St Louis Circuit Judge Timothy Wilson wrote in the decision .  attorney, Neil Bruntrager, argued that Mr Smith, a 24-year-old parole violator with previous convictions for gun and drug crimes, tried to run over the two officers. Mr Stockley fired seven shots as Smith sped away. A chase ensued.  At the end of the chase, Mr Stockley opened fire only when Mr Smith, still in his car, refused commands to put up his hands and reached along the seat “in the area where the gun was,” Mr Bruntrager said. Mr Stockley said he climbed into Smith's car and found a revolver between the center console and passenger seat.

Incident[edit]

Police officer Stockley and his partner have stated they saw Smith engaged in a drug deal. Dashcam video from their police car recorded Smith reversed his car into their vehicle twice, before driving off. A three minute high-speed car chase ensued, then Stockley told his partner to ram Smith's car. Stockley was recorded during the chase as saying "going to kill this motherfucker, don’t you know it".[1] After the car was stopped, Stockley and his partner, Brian Bianchi, approached Smith's vehicle at West Florissant and Acme Avenues in north St. Louis.[3] Witnesses testified and dashcam footage showed that Stockley yelled at Smith through the driver side window of Smith's vehicle to open the door. Stockley testified that Smith did not comply but rather appeared to be reaching around the interior of his vehicle in search of something which Stockley believed to be a gun. Stockley testified that Smith's demeanor suddenly changed, which Stockley believed indicated that Smith had found the alleged gun. Stockley then opened fire through the window and shot five times, killing Smith. A handgun was later found in the vehicle between the driver's seat and center console.[2][4]

Criminal charges and trial[edit]

Jason Stockley was charged by St. Louis County prosecutors with first-degree murder in May 2016. He was arrested at his home in Houston, Texas.[5]
During the trial, the prosecution had argued that the revolver found in Smith's car had been planted by Stockley to justify the shooting. However, in his ruling, the judge said the prosecution's argument was not supported by the evidence.[4] He ruled this despite DNA experts testifying that the gun recovered had no trace of Smith's DNA on it. Officer Stockley's DNA, however, was present. Smith was previously convicted for drug distribution and unlawful possession of a firearm, and was out on probation for a theft charge at the time of the incident.[6]
